By hiring Liberty Gutters ("Company," "we," "us," or "our") to provide gutter services, including but not limited to gutter installation, cleaning, repair, inspection, and maintenance ("Services"), you ("Customer," "you," or "your") agree to these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Services.
2. Services Provided
We provide gutter-related services at residential and commercial properties in New Jersey and surrounding areas. The specific scope of work, schedule, and pricing will be outlined in a written estimate, proposal, or contract provided before work begins.
3. Estimates and Payments
- All estimates are valid for 30 days unless otherwise stated.
- A deposit may be required before services begin.
- Full payment is due upon completion of services unless otherwise agreed in writing.
- We accept: Cash, Credit Cards, Bank Transfers.
- Late payments may be subject to interest or collection costs as permitted by law.
4. Customer Responsibilities
You agree to:
- Provide safe and reasonable access to the property.
- Ensure that driveways, walkways, and work areas are clear of obstructions (e.g., vehicles, debris, locked gates).
- Disclose any known hazards (e.g., electrical wires, weak roofing, pest infestations).
- Obtain any necessary homeowner association or third-party approvals, if applicable.
5. Scheduling and Cancellations
- We will make reasonable efforts to complete services on schedule, but weather, emergencies, and other unforeseen circumstances may cause delays.
- Cancellations must be made at least 24 hours in advance to avoid a cancellation fee.
- If work cannot be performed due to unsafe conditions (including but not limited to severe weather, hazardous structures, or unsafe access), we may reschedule at our discretion.
6. Warranties and Limitations
We warrant that our services will be performed in a professional manner consistent with industry standards. Any manufacturer warranties on materials will be passed on to you.
We are not responsible for:
- Pre-existing conditions or damage to your property.
- Future blockages, damage, or leaks caused by weather, natural wear, or failure to maintain gutters.
- Damage caused by animals, pests, tree limbs, or acts of God.
Disclaimer: Except as expressly provided, we make no other warranties, express or implied, including warranties of merchantability or fitness for a particular purpose.
7. Liability
To the fullest extent permitted by law, our liability for any claim related to our services is limited to the amount you paid for those services. We are not liable for indirect, incidental, or consequential damages. You agree to hold us harmless from claims arising out of your failure to maintain your gutters after services are completed.
8. Insurance
We maintain appropriate liability insurance and worker’s compensation coverage as required by New Jersey law. Proof of insurance is available upon request.
9. Termination
We may refuse or terminate services if:
- Payment is not made as agreed.
- Unsafe conditions prevent us from completing the work.
- You fail to comply with these Terms.
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of New Jersey. Any disputes will first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be resolved in the courts of Passaic County, New Jersey.
11. Changes to Terms
We may update these Terms from time to time. The updated version will be posted on our website or provided upon request. Continued use of our Services constitutes acceptance of the updated Terms.
